Shipping policy

This U.S. Shipping Policy (the “Policy”) governs the terms and conditions under which Oxide Hookah (“Oxide Hookah,” “we,” “us,” or “our”), a Canada-based entity, provides shipping and delivery services to customers located in the United States. This Policy is an integral part of our Terms and Conditions of Sale and should be read in conjunction with our Privacy Policy and any applicable U.S. consumer protection laws.


1. Order Acceptance and Fulfillment

1.1 Order Confirmation
Upon placing an order through our website (the “Site”), you will receive an automated email confirmation. This confirmation does not constitute formal acceptance of your order, but merely acknowledges receipt.

1.2 Order Processing Timeline
Orders destined for the United States are generally processed within one (1) to two (2) business days, excluding Canadian statutory holidays and weekends. Processing times may vary based on inventory levels, order volume, or operational limitations.

1.3 Right to Refuse Fulfillment
We reserve the right, at our sole discretion, to cancel or refuse any order for reasons including, but not limited to, product availability, pricing discrepancies, suspected fraud, or violations of our Terms and Conditions.


2. Shipping Carriers and Methods

2.1 Designated Carriers
We ship U.S.-bound orders using international and cross-border carriers, including but not limited to:

  • Canada Post, with final-mile delivery through USPS (United States Postal Service),

  • UPS (United Parcel Service),

  • DHL Express.

We reserve the right to change or substitute carriers at our discretion, provided this does not materially alter the service level selected by the customer.

2.2 Risk of Loss and Carrier Liability
Once the package has been transferred to the designated shipping carrier, risk of loss and title shall pass to the customer. Oxide Hookah is not liable for delays, misdeliveries, or losses that occur during transit.

2.3 Estimated Delivery Windows
Estimated delivery timelines are provided at checkout and are based on carrier estimates. Such timelines are indicative only and are not binding guarantees.


3. Shipping Fees and Charges

3.1 Real-Time Rate Calculation
Shipping fees for U.S. orders are calculated dynamically at checkout based on the package weight, dimensions, destination, and selected service level.

3.2 Tax Treatment and Canadian Status
As a Canada-based business, Oxide Hookah does not collect or remit U.S. state sales taxes at the point of sale. Customers are responsible for complying with any applicable state use tax or import regulations as required by their jurisdiction.


4. Duties, Taxes, and Import Regulations

4.1 Customs Duties and Brokerage
Orders shipped from Canada into the United States may be subject to duties, taxes, and/or brokerage fees assessed by U.S. Customs and Border Protection or the shipping carrier. These fees are not included in our product or shipping prices.

4.2 Customer Responsibility
The customer is solely responsible for paying all applicable customs duties, tariffs, or fees upon import. Oxide Hookah is not responsible for delays, returns, or seizures caused by customs clearance issues. It is the customer’s responsibility to ensure the legality of the purchased items in their jurisdiction.


5. Address Accuracy and Customer Obligations

5.1 Obligation to Provide Accurate Address Information
Customers must enter a complete and deliverable U.S. shipping address at the time of purchase. This includes suite numbers, apartment identifiers, zip codes, and full recipient names.

5.2 Undeliverable Packages and Incorrect Addresses
Oxide Hookah shall not be liable for failed deliveries resulting from incorrect or incomplete address information. If a package is returned due to address errors, the original shipping fee is non-refundable, and the customer may be charged a re-shipping fee.


6. Delivery Delays and Exceptions

6.1 Force Majeure
We are not responsible for delivery delays caused by events outside our control, including but not limited to natural disasters, customs inspections, strikes, pandemics, governmental actions, or service disruptions from the carrier.

6.2 Returned or Refused Deliveries
If your package is returned or refused at the border, we will attempt to contact you for resolution. Re-delivery may require additional payment. If the customer cannot be reached within a reasonable timeframe, the order may be canceled without refund.


7. Claims for Damaged or Lost Shipments

7.1 Reporting Period
Claims for damage, loss, or non-receipt must be reported in writing within forty-eight (48) hours of the delivery confirmation or expected delivery date.

7.2 Supporting Documentation
To file a claim, you must provide photographic evidence of any damage, a copy of your packing slip, and images of the original packaging. These materials are necessary for filing a courier claim.

7.3 Remedies and Resolution
If a claim is approved, Oxide Hookah may, at its sole discretion, issue a replacement or refund for the affected item(s). Claims resulting from customer negligence, misuse, or unauthorized reshipment are not eligible for resolution.
